Abstract:

This paper is a sequel to the general subject of construction mediation that appeared in Volume 11, No. 1 of the Journal of the National Academy of Forensic Engineers, April 1985 and in Volume 11, No. 2 of the Journal in December 1985. It concerns a recommended procedure to solve construction disputes at the time of their inception, or shortly thereafter. The prime purpose is to avoid long and costly litigation in the traditional process through the courts or at extended arbitration hearings, since many of these forums take place well after the completion of construction.
